Art Auction Rules for Online Purchases and Insured Delivery
1. Bidding and Sale Process
Bidders must be at least eighteen years of age and legally capable of entering into binding contracts.
All bids placed during a timed or live online auction are considered binding offers.
The highest bid at the close of the auction, provided it meets or exceeds any set reserve price, will be deemed the winning bid.
Once the auction ends and a bid is accepted, a contract of sale is automatically formed. A confirmation email and invoice will be issued to the winning bidder.
2. Payment Terms
Payment must be completed within seven calendar days from the close of the auction, unless a different arrangement is agreed in writing.
Accepted payment methods include bank transfer, debit or credit card, or other secure online payment platforms as detailed in the invoice.
Failure to make full payment within the specified period may result in cancellation of the sale, re-listing of the item, and legal recovery action if necessary.
3. Transfer of Ownership
Legal ownership of the artwork passes to the buyer only after full payment has been received and cleared.
Responsibility for any risk of loss or damage does not transfer until the item has been physically delivered to the buyer.
4. Delivery and Insurance
All artworks are packaged professionally using high-quality materials suited to the nature and value of the item.
We use reliable and trackable courier or logistics services for all national and international shipments.
Delivery is fully insured. This means the item is covered against loss, theft, or damage during transit up to the total value of the purchase, including applicable fees.
Upon receipt, buyers must inspect their purchase and report any visible damage or concerns within forty-eight hours. Claims made beyond this time may not be accepted.
5. Returns and Refunds for Auction Sales
Returns are generally not accepted in auction sales due to the legal exemption from standard consumer cooling-off rights.
However, refunds or replacements may be granted if the item is found to be materially damaged on delivery or if it was significantly misdescribed.
Any return must be supported by evidence and subject to our assessment. The item must be returned before any refund is processed.
6. Buyer’s Premium and Taxes
A buyer’s premium may apply. This is an additional percentage charged on top of the final hammer price and will be clearly disclosed before bidding.
Buyers are responsible for any import duties, customs fees, or value added tax required for international shipments.
7. Certificate of Authenticity
When applicable, a Certificate of Authenticity will accompany the artwork. This may be issued by the artist or by Arts Haven Studio.
8. Legal Framework
By participating in the auction, the buyer agrees to be bound by these terms and any additional conditions published during the registration process.
These rules are governed by the laws of England and Wales. Any disputes arising will be subject to the exclusive jurisdiction of the courts of England.
